Explanation of Terms

Visa Classification: The type of nonimmigrant visa you are applying for.

Fee: The reciprocity fee, also known as the visa issuance fee, you must pay. This fee is in addition to the nonimmigrant visa application fee (MRV fee).

Number of Entries: The number of times you may seek entry into the United States with that visa. "M" means multiple times. If there is a number, such as "One", you may apply for entry one time with that visa.

Validity Period: This generally means the visa is valid, or can be used, from the date it is issued until the date it expires, for travel with that visa. If your Validity Period is 60 months, your visa will be valid for 60 months from the date it is issued.

  1. The validity of A-3, G-5, and NATO 7 visas may not exceed the validity of the visa issued to the person who is employing the applicant. The "employer" would have one of the following visa classifications:

    • A-1
    • A-2
    • G-1 through G-4
    • NATO 1 through NATO 6

  2. An E-1 and E-2 visa may be issued only to a principal alien who is a national of a country having a treaty, or its equivalent, with the United States. E-1 and E-2 visas may not be issued to a principal alien if he/she is a stateless resident or national of a country without a treaty.  *When the spouse and children of an E-1 or E-2 principal alien are accorded derivative E-1 or E-2 status and are themselves a national of a country that does not have a treaty with the United States – the reciprocity schedule, including any reciprocity fees, of the principal alien’s country of nationality should be used.  **Spouse and children of an E-1 or E-2 visa principal applicant, where the spouse and children are also nationals of a country that has a treaty with the United States – the reciprocity schedule, including any reciprocity fees, of the spouse and children’s country of nationality should be used.  

    *Example 1: John Doe is a national of Country A that has an E-1/E-2 treaty with the U.S. however his wife and child are nationals of Country B which has no treaty with the U.S. The wife and child would, therefore, be entitled to derivative status and receive the same reciprocity as John Doe, the principal visa holder.

    **Example 2:  Mike Doe is a national of Country Y that has an E-1/E-2 treaty with the U.S. however his wife and child are nationals of Country Z that also has a treaty with the U.S. The wife and child would, therefore, be entitled to derivative status and receive the reciprocity issued to nationals of Country Z.

  3. The validity of H-1 through H-3, O-1 and O-2, P-1 through P-3, and Q visas may not exceed the period of validity of the approved petition or the number of months shown, whichever is less.

    Under 8 CFR §214.2, H-2A and H-2B petitions may generally only be approved for nationals of countries that the Secretary of Homeland Security has designated as participating countries. The current list of eligible countries is available on USCIS's website for both H-2A and H-2B visas. Nationals of countries not on this list may be the beneficiary of an approved H-2A or H2-B petition in limited circumstances at the discretion of the Department of Homeland Security if specifically named on the petition.  

    Derivative H-4, L-2, O-3, and P-4 visas, issued to accompanying or following-to-join spouses and children, may not exceed the validity of the visa issued to the principal alien.

  4. There is no reciprocity fee for the issuance of a J visa if the alien is a United States Government grantee or a participant in an exchange program sponsored by the United States Government.

    Also, there is no reciprocity fee for visa issuance to an accompanying or following-to-join spouse or child (J-2) of an exchange visitor grantee or participant.

    In addition, an applicant is eligible for an exemption from the MRV fee if he or she is participating in a State Department, USAID, or other federally funded educational and cultural exchange program (program serial numbers G-1, G-2, G-3 and G-7).

    However, all other applicants with U.S. Government sponsorships, including other J-visa applicants, are subject to the MRV processing fee.

  5. Under the North American Free Trade Agreement (NAFTA), Canadian and Mexican nationals coming to engage in certain types of professional employment in the United States may be admitted in a special nonimmigrant category known as the "trade NAFTA" or "TN" category. Their dependents (spouse and children) accompanying or following to join them may be admitted in the "trade dependent" or "TD" category whether or not they possess Canadian or Mexican nationality. Except as noted below, the number of entries, fees and validity for non-Canadian or non-Mexican family members of a TN status holder seeking TD visas should be based on the reciprocity schedule of the TN principal alien.

    Canadian Nationals

    Since Canadian nationals generally are exempt from visa requirement, a Canadian "TN' or "TD" alien does not require a visa to enter the United States. However, the non-Canadian national dependent of a Canadian "TN", unless otherwise exempt from the visa requirement, must obtain a "TD" visa before attempting to enter the United States. The standard reciprocity fee and validity period for all non-Canadian "TD"s is no fee, issued for multiple entries for a period of 36 months, or for the duration of the principal alien's visa and/or authorized period of stay, whichever is less. See 'NOTE' under Canadian reciprocity schedule regarding applicants of Iranian, Iraqi or Libyan nationality.

    Mexican Nationals

    Mexican nationals are not visa-exempt. Therefore, all Mexican "TN"s and both Mexican and non-Mexican national "TD"s accompanying or following to join them who are not otherwise exempt from the visa requirement (e.g., the Canadian spouse of a Mexican national "TN") must obtain nonimmigrant visas.

    Applicants of Iranian, Iraqi, Libyan, Somalian, Sudanese, Syrian or Yemeni nationality, who have a permanent resident or refugee status in Canada/Mexico, may not be accorded Canadian/Mexican reciprocity, even when applying in Canada/Mexico. The reciprocity fee and period for "TD" applicants from Libya is $10.00 for one entry over a period of 3 months. The Iranian and Iraqi "TD" is no fee with one entry over a period of 3 months.

  6. Q-2 (principal) and Q-3 (dependent) visa categories are in existence as a result of the 'Irish Peace Process Cultural and Training Program Act of 1998'. However, because the Department anticipates that virtually all applicants for this special program will be either Irish or U.K. nationals, the Q-2 and Q-3 categories have been placed only in the reciprocity schedules for those two countries. Q-2 and Q-3 visas are available only at the Embassy in Dublin and the Consulate General in Belfast.

  7. No S visa may be issued without first obtaining the Department's authorization.

  8. V-2 and V-3 status is limited to persons who have not yet attained their 21st birthday. Accordingly, the period of validity of a V-2 or V-3 visa must be limited to expire on or before the applicant's twenty-first birthday.

  9. Posts may not issue a T-1 visa. A T-1 applicant must be physically present in the United States, American Samoa, the Commonwealth of the Northern Mariana Islands or a U.S. port of entry, where he/she will apply for an adjustment of status to that of a T-1. The following dependents of a T-1 visa holder, however, may be issued a T visa at a U.S. consular office abroad:

    • T-2 (spouse)
    • T-3 (child)
    • T-4 (parent)
  10. The validity of NATO-5 visas may not exceed the period of validity of the employment contract or 12 months, whichever is less.

  11. The validity of CW-1 and CW-2 visas shall not exceed the maximum initial period of admission allowed by DHS (12 months) or the duration of the transition period ending December 31, 2014, whichever is shortest.

  12. The validity of E-2C visas shall not exceed the maximum initial period of admission allowed by DHS (24 months) or the duration of the transition period ending December 31, 2014, whichever is shortest.

Documents are available for all births, marriages and deaths since 1992. Documents are available for some births, marriages and deaths since 1980. Because all archives were destroyed during the regime of 1975-1979, no documents from those years are available.

The Cambodian government embarked on a new civil registration campaign. The Ministry of Interior introduced procedural changes in August 2002, requiring all Cambodians to obtain a new version of certificates of birth, marriage and death. Persons with previously issued certificates are required to convert them to the new format. The old version of the certificates can no longer be used as of January 2007. Persons are issued colored original birth, marriage and death certificates, based on information provided by the requestor.  Additional official black-and-white certified true copies may also be requested.

By law, contemporaneous civil documents are issued free of charge. However, Cambodians are generally asked to pay some fees to officials to expedite the issuance of the documents.

Cambodian law expects citizens to retain their original civil documents for life. Using the originals, citizens may request official certified true copies at the commune office where the originals were issued within the same year, and/or at the “one-window” office of the respective district hall. The official certified true copies can be requested at no cost. Replacements for lost originals are available by following the procedure set forth by the General Department of Identification of the Ministry of Interior.

Despite the changes, Cambodian documents are of poor quality, using low-tech and inexpensive methods. They are often prone to forgery. The Embassy may verify authenticity of a given document with the relevant authorities when necessary.

Birth Certificates

Registration Criteria: When a child is born, the father or mother or legal guardian of the parents or adult relatives of the child or lawful designated official shall register the birth with the vital record officer at the commune office of the parents’ residency or of the actual child’s birthplace.  

Procedure for Obtaining: Any person (mentioned above) who wishes to register a birth shall appear before the vital record officer with the required documents: hospital/medical birth certificate, family book of both parents, parents’ certified copies of birth certificates, and parents’ Cambodian identity cards or passports.  

Certified Copies: Certified copies are available upon request.

Death Certificates

Registration Criteria: To register for death certificate, the person’s immediate family, adult relatives, or lawful designated officials should report the death to the vital record officer at the commune office, where the death occurred or of the deceased’s residence.

Procedure for Obtaining: Any person (mentioned above) who wish to register for a death certificate shall appear before the vital record officer with the required documents: hospital certificate if a person died at the hospital, police report if a person was murdered or related to a crime, family book with the name of the deceased person listed, and a certified copy of birth certificate of the deceased person.

Marriage Certificates

Registration Criteria: To legalize the marriage, a new couple shall register for marriage certificate at the commune office of either the bride’s or the groom’s residency.

Procedure for Obtaining: A new couple shall present themselves and provide thumbprints to the vital record officer with their marriage announcement letter and two adult witnesses to officially register their marriage.  The couple must provide the identification information including copies of their birth certificates and  identification cards.

Divorce Certificates

Issuing Authority Personnel Title: Judge

Registration Criteria: Any party of a marriage can file a divorce complaint to court.

Procedure for Obtaining: The parties shall present the required documents: marriage certificate, family book and other relevant supporting documents.

Certified Copies: Certified copies are available.

Alternate Documents: There are no alternate documents.

Exceptions: There are no exceptions.

Comments: The judge shall issue a “Ruling Order” if both the husband and wife agree to proceed with the divorce. However, a judge shall issue a “Civil Judgement” if the complaint comes from one party only.  The Ruling Order or Civil Judgement shall be accompanied with “Certification of Order/Judgement Finality” which shall be issued by Court Clerk, with red seal and signature, generally 30 days after the issuance of Ruling Order or Civil Judgement (if no appeal has been made).

Registration Criteria: Court of Adoptee or Adopter’s residence issues “Full Adoption” or “Simple Adoption”

Procedure for Obtaining:

  • For Full Adoptions:
    • Adoptee must be under 8
    • Adopter must be at least 25 years old
    • Adopter must be at least 20 years older than adoptee
    • Adopter must be legally married and file jointly for adoption with the spouse
    • Parental relationship between Adoptee and his/her natural parents is terminated by the adoption order
  • For Simple Adoptions:
    • No limit on the age of Adoptee
    • Adopter must be at least 25 years old
    • Adopter must be older than Adoptee
    • Adopter can be single. However, if he or she has a spouse, the consent of the spouse is required
    • Parental relationship between Adoptee and his/her natural parents is not terminated by the adoption

Document Name: Cambodian Identity Card

Special Seal(s) / Color / Format: The card has a green tint and has information on both sides.

  • Front side: On the upper left corner, there is a photo of the individual with the signature underneath. The only Latin letters in Cambodian ID cards are those that duplicate the holder’s name and within the Machine-Readable Zone (MRZ). However, there’s much more data such as ID number (located at the top right corner), date of birth, sex, height, place of birth, current address, date of Issue and date of expiry, and identifiers (this field contains distinctive features of the individual, for example, moles, scars, etc.)

  • Back side: There is a small print of the Cambodia flag on the upper left and directly below the flag is a smart chip. On the upper right, there is a national emblem (golden color). Below that, there is a hologram circular seal of the Ministry of Interior. In between, English and Khmer text is in blue. On the bottom are two lines of Khmer text in black.

Issuing Authority Personnel Title:  There is no issuing authority personnel title.

Registration Criteria: Cambodian citizens aged 15 and over can request Identity Card at the communal police post, district police post, or General Department of Identification of the Ministry of Interior.

Procedure for Obtaining: The requesting person shall have required documents: certified copy of birth certificate, family/residence record book and other supporting documents.

Certified Copies: Certified copies are not available.

Comments: Cambodian citizens aged 15 and over are required to have a Cambodian Identity Card for administrative purposes and to exercise their rights and obligations as stated by law. 

Police Certificates

Issuing Authority Personnel Title: Director of the Criminal Records Office and the Minister of Justice

Registration Criteria: Cambodian citizens, residents or former residents can request Bulletin of Criminal Record No. 3 online or at the Criminal Records Office at the Ministry of Justice

Procedure for Obtaining: The requesting person can choose to fill out an online application form using the CR-MOJ mobile application or accessed via https://cr.moj.gov.kh/, and follow tutorial on the application to enter and submit required information and documents.  The person can also apply in person at the Criminal Records Office with the following required documents:

  • Completed application and biological information forms (can be obtained at the Criminal Records Office)
  • One photograph (size 4cm x 6cm)
  • Original and a copy of birth certificate and residence book or family book (for Cambodian applicants)
  • Valid student card (for Cambodian students)
  • A copy of the applicant’s visa and passport biographical page, and original residence certification letter(s) from the commune office(s) where the applicant has resided (for foreign applicants).

Comments: Cambodian Police Certificates or Bulletins of Criminal Record No. 3 are based on records of court judgements of unsuspended sentences of imprisonment in felony or misdemeanor cases only and do not include sentences of convicts who have received rehabilitation.

 

Court Records

Registration Criteria: A person, their lawyer or guardian, can request a Certified Copy of Court Judgement at the judgement issuing court

Procedure for Obtaining: Procedure may vary depending on the issuing court.  A person, their lawyer or guardian, may submit a request for Certified Copy of Court Judgement at the court which issued the judgment.

Certified Copies: Certified copies are available.

Exceptions: There are no exceptions.

Comments: The Certified Copy of Court Judgement shall be accompanied with “Certification of Judgement Finality” which shall be issued by Court Clerk with red seal and signature.

 

Prison Records

Available: Besides Bulletins of Criminal Record No. 3, there is no standard for other Prison Records in Cambodia.  A person, whose imprisonment records are not listed on their Cambodian Police Certificates or Bulletins of Criminal Record No. 3, shall obtain below documents to present as their Prison Records.  Format of each document varies depending on the issuing authority.  The documents generally have red seal at the bottom along with signature of the issuing authority personnel.

  • Court Records or Certified Copy of Court Judgement and Certification of Judgement Finality (mentioned above)
  • Release Order issued by investigating judge or trial judge
  • Release Letter issued by prison warden.

Available: There is no standard for Military Records in Cambodia. However, assignments and dismissals of Military personnel are announced on either Royal Decree (issued by the King), Sub-Decree (issued by the Prime Minister), or Proclamation (or Prakas, issued by Minister of Defense), depending on the personnel’s rank or position. Based on standard practice, the military personnel or veteran can obtain their military record from their own command, base, or unit.

Registration Criteria: Cambodian citizens can request a Regular Passport at Passport Office in Phnom Penh or at provincial offices in Battambang, Banteay Meanchey, Koh Kong or Siem Reap.

Procedure for Obtaining: A person shall apply with the following required documentation: a completed application form (this form can be obtained at the Passport Office or completed via online.gdi.gov.kh website), Cambodian identity card or birth certificate, family book or residence book, and any official document that present the nationality, identity, and the address of the requesting person. For applicants under 15 years old, letter from parents or guardian(s) and proof of familial relationship are also required.

Comments: Regular Passports have 5-year validity for children under 6 years old and 10-year validity for everyone aged 6 years and older.

Registration Criteria: A government official going abroad for official mission, with title/position listed on the Sub-Decree on Granting and Use of Diplomatic and Official Passports, can request for an Official Passport.  

Procedure for Obtaining: The requesting person or their department shall submit supporting documents and a request letter to Ministry of Foreign Affairs & International Cooperation listing purpose of their foreign mission, countries where the mission will take place, and period of the mission.

Exceptions: There are no exceptions.

Comments: Validity of Service Passport is no more than five years and is non-renewable.

Fees: Free (processing time: 7 days)

Issuing Government Authority: Ministry of Foreign Affairs & International Cooperation

Issuing Authority Personnel Title: Secretary of State

Registration Criteria: The requesting person shall be a high-ranking dignitary, high-ranking government official, their spouse, their unmarried dependent child under 18 years old, or government official or dignitary in need of the passport to complete a mission and has title/position listed on the Sub-Decree on Granting and Use of Diplomatic and Official Passports.  Diplomatic Passport cannot be issued to advisor or dignitary who does not have Cambodian citizenship at birth unless the passport issuance is deemed absolutely necessary by the government.

Procedure for Obtaining: The requesting person or their department shall submit supporting documents and a request letter to Ministry of Foreign Affairs & International Cooperation listing purpose of their mission, countries where the mission will take place, and period of the mission.

Exceptions: There are no exceptions.

Comments: Validity of Diplomatic Passport is no more than five years and is non-renewable.

1- National High School Examination and Certificates

Cambodia has an annual national high school examination. No exams were held from 1975 to 1982. Official result certificates are issued by the Ministry of Education, Youth and Sport. Students were tested on 9 subjects until 2006, on 10 subjects until 2013, and on 7 subjects thereafter, except in 2020 (during COVID-19 pandemic) when the Ministry granted automatic pass to students who had registered to take the exam.

Prior to the issuance of the formal certificate, “Certificate of Upper-Secondary Education”, the Ministry will issue a “Temporary Certificate” which is formally called “Provisional Certificate of Upper-Secondary Education” or “Provisional Certificate of Senior Secondary Education” to all students regardless of whether they passed or failed the exam. Their exam result is also listed on the certificate.

However, between 2002 and 2006, due to high volume of workload, instead of a “Provisional Certificate of Upper-Secondary Education”, the Ministry issued a “bulletin result or transcript” which was formally called a “Result of High School Examination” or “Result of Upper-Secondary Education Examination” to all students who passed the exam.

2- Formats of Certificates

a.     Provisional Certificate of Upper-Secondary Education

The certificates issued in 2008 and 2009 are computer generated, in blue and multi-color ink, with a wet seal on A4 plain paper and a digital picture of the applicant.

The certificates issued in and before 2007 were also computer generated which were similar to 2008 and 2009 certificates. The differences are (1) the Ministry used a dry seal, (2) ¾ length sheet and (3) they did not use digital photo.

The certificates issued in 2007 and afterward have barcode on the bottom left.

The “Provisional Certificate of Upper-Secondary Education” has no stylistic border and there is only one signature, which is the signature of director of department of secondary education.

b.     Result of Upper-Secondary Education Examination

The “Provisional Certificate of Upper-Secondary Education” and “Result of Upper-Secondary Education Examination” are largely the same.

Some of the “Result of Upper-Secondary Education Examination” bulletins issued in and before 2006 have non-digital photo of the student while some do not have photo.  The bulletins were computer generated, printed on A4 plain paper, and most of information is in black ink.

The “Result of Upper-Secondary Education Examination” has no stylistic border and there is only one digital signature, which is the signature of the director of department of secondary education.

c.     Certificate of Upper-Secondary Education

From 2002 present, the Ministry has issued a “Certificate of Upper-Secondary Education” which contains information such as the student’s final grade, national percentile score, grades for each subject, number of subjects passed, and exam location.  Format may vary slightly depending on the issuance year. The background of the certificate is the logo of the Ministry of Education, Youth and Sport (prior to 2002, there was no logo). The certificate is on A4 paper with a stylistic border, generated primarily in blue and black ink (parts of the certificate are multicolored), has a digital photo of the student and two red seals.
